§ I Conclusion of contract
The contract is concluded on the basis of the customer’s order by completing and confirming the Internet store and confirmation or delivery of the order by Rosche. Offers on our websites are subject to change and non-binding, unless a binding assurance is expressly given.
§ 2 Prices, quantities
The prices quoted apply to orders placed via the Internet and are final prices in euros including the applicable VAT.
§ 3 Delivery and shipping conditions
Delivery is made directly by ROSCHE to the delivery address specified by you. If an item is not available, it will be delivered to you as soon as possible. If a subsequent or replacement delivery is not possible, we are entitled to withdraw from the contract and in this case will inform you immediately of the unavailability.
§ 4 Deliveries to Germany
For deliveries to selected islands in the North Sea and Baltic Sea, an island surcharge may be charged due to the increased transportation costs.
§ 5 Deliveries to EU countries
We deliver to Belgium, Denmark, Austria, Luxembourg, France, Great Britain, Italy, Spain, Portugal, the Netherlands, Finland and Sweden. The respective shipping costs will be charged.
§ 6 Deliveries to countries other than those listed above

§ 7 Payment methods / terms of payment
Our invoices shall be deemed accepted unless objected to in writing within 14 days of the invoice date. Pallets, crates, returnable bottles etc. (with the exception of all non-returnable containers) are only provided to the buyer on loan. The deposit is charged at the applicable rates and is included in the invoice amount. Orders within Germany can only be paid for in advance. Orders from EU countries can be paid in advance. The EU bank transfer (IBAN: DE32 2666 1380 0001 1703 00 BIC: GENO DE F1 HLN) is mandatory, otherwise the bank charges (currently EURO 7.00) will be charged. Orders from other countries can be paid in advance. Any bank charges incurred will be invoiced. Objections to bank direct debits made by us on the basis of a completed order transaction or other payments not made or subsequently rejected shall entitle us to charge a processing fee of EURO 40.00. You may only set off undisputed or legally established claims against the claim for payment of the purchase price.
§ 8 Retention of title
Title to the goods shall remain with the supplier until all claims for payment have been paid in full. If no payment is received, the purchase price claim shall remain valid. Any additional costs incurred as a result shall be charged to the customer.
§ 9 Right of withdrawal
The Distance Selling Act applies to sales contracts between a company and consumers that were concluded using exclusively means of distance communication. A consumer is a buyer who concludes a purchase contract for a purpose that cannot be attributed to his commercial or independent professional activity. Consumers can cancel the purchase without giving reasons within a period of two weeks in writing or by email or by returning the goods. The revocation period begins with the receipt of the order confirmation. Timely dispatch of the revocation is sufficient to meet the deadline. The revocation must be sent to info@ROSCHE.de or JOS.ROSCHE GmbH & Co. KG, Neustadtstr. 35-38,49740 Haselünne. If the value of the goods is less than EURO 40.00, you shall bear the shipping costs for returning the goods. In the case of a return shipment with a value of goods over EURO 40.00, the shipping costs will be borne. Please stamp the package sufficiently to avoid penalty postage. The postage amount will then be refunded immediately. If damaged or worn goods are returned, the reduction will be deducted; this can be avoided by returning the goods without signs of use.
§ 10 Damage in transit
In the case of immediately recognizable damage that was obviously caused by transport, we ask you to have this confirmed by the carrier immediately upon receipt of the goods. We also request that you notify ROSCHE of the damage, stating your order details. You will receive a replacement delivery immediately.
§ 11 Other complaints
Please notify us of any obvious damage or defects within 14 days. You will receive a replacement delivery immediately. If a consignment arrives incomplete, please also report this within 14 days for the purpose of settlement. The warranty is provided in accordance with the statutory provisions, whereby ROSCHE is entitled to deliver new goods in the event of a defect.
§ 12 Data protection / data security
Customer data is stored and processed by us in compliance with the relevant provisions of the Federal Data Protection Act (BDSG) and the Teleservices Data Protection Act (TDDSG). Your personal data will only be collected for specified, clear and legitimate purposes and will not be stored for longer than necessary. You have a right to information as well as a right to correction, blocking and deletion of your stored data. Please contact info@ROSCHE.de or send us your request by post or fax. We do not pass on your personal data, including your postal address and e-mail address, to third parties. Exceptions to this are our service partners who require the transmission of data for order and payment processing. In these cases, however, the scope of the data transmitted is limited to the minimum required.
§14 Scope of application
Our General Terms and Conditions apply exclusively to private customers. German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
§15 Place of jurisdiction
As far as permissible, the place of jurisdiction for all legal disputes shall be Meppen. However, we are also entitled to take legal action at your general place of jurisdiction.
§16 Severability clause
Should individual provisions of these GTC be invalid or void, this shall not affect the validity of the remaining provisions.
